Whether you\u2019re a user of e-cigarettes or a public business looking to abide by the law, knowing the current regulations will help you know what\u2019s allowed and what isn\u2019t when it comes to electronic cigarettes. We\u2019ll help you make sense of the current state and federal laws regarding e-cigarettes, how they differ from\u00a0<a href=\"https:\/\/www.signs.com\/blog\/no-smoking-laws-for-all-fifty-states\/\">smoking laws<\/a>, and whether or not signage has the rule of law.<\/p>\n<\/div><h2 class=\"bde-heading-15608-105 bde-heading\">\nWhat are e-cigarettes and how do they differ from regular cigarettes?\n<\/h2><div class=\"bde-rich-text-15608-106 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p>An electronic cigarette is a device used to deliver concentrated nicotine into the body. Unlike cigarettes which burn tobacco to produce nicotine, e-cigarettes use a battery-powered vaporizer to turn liquid nicotine into vapor (also known as electronic nicotine delivery system \u2013 ENDS), which is inhaled and absorbed into the lungs. As of August 8, 2016, the\u00a0<a href=\"http:\/\/www.fda.gov\/TobaccoProducts\/Labeling\/RulesRegulationsGuidance\/ucm394909.htm#rule\">FDA has established new e-cigarette regulations<\/a>\u00a0based on the fact that the nicotine present in the device is a byproduct of tobacco. As such, e-cigarettes are classified as tobacco products. Tobacco products are regulated to prevent purchasing by children under 18 years of age, as well as to limit the exposure of secondhand smoke in public places.<\/p>\n<\/div><div class=\"bde-div-15608-110 bde-div\">\n  \n  \n\t\n\n\n\n<p class=\"bde-text-15608-111 bde-text\">\nWhat are the FDA\u2019s regulations on e-cigarettes? What\u2019s the difference between smoking laws and e-cigarette laws?\n<\/p><div class=\"bde-rich-text-15608-112 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p>In most states, e-cigarette regulations fall underneath the same regulations as\u00a0<a href=\"https:\/\/www.signs.com\/blog\/no-smoking-laws-for-all-fifty-states\/\">state-by-state smoking laws<\/a>. Since some states may not have similar regulations for both, it is best to check with local authorities on what regulations apply to e-cigarettes and what apply to smoking. With the FDA\u2019s newly established regulations on e-cigarettes, states may decide to change their stance on how they approach such laws. We will address the state-by-state laws for e-cigarettes, as they stand now, in the next section.<\/p><p>The FDA has a comprehensive website that explains how the\u00a0<a href=\"http:\/\/www.fda.gov\/TobaccoProducts\/Labeling\/RulesRegulationsGuidance\/ucm394909.htm#rule\">new regulations affect the sale and use of e-cigarettes and tobacco cigarettes<\/a>. With e-cigarettes being categorized as a tobacco product, the sale of such devices is regulated as would the sale of tobacco cigarettes. In order to purchase e-cigarettes you must be 18 years or older and have a valid photo ID. Flavored e-cigarettes can also be sold and purchased by consumers 18 years or older. The FDA requires that by 2018, all e-cigarettes must be sold with the warning:\u00a0<b>\u201cWARNING: This product contains nicotine. Nicotine is an addictive chemical.\u201d\u00a0<\/b>Regulations are slightly different with tobacco cigarettes; no matter the age of the consumer it is illegal to sell or purchase flavored tobacco cigarettes.<\/p>\n<\/div>\n<\/div><h2 class=\"bde-heading-15608-113 bde-heading\">\nWhat are the individual state regulations for e-cigarettes?\n<\/h2><div class=\"bde-rich-text-15608-114 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p>Though the FDA has standardized rules for e-cigarettes sales, the specific usage of them is regulated at the state level.<a href=\"http:\/\/publichealthlawcenter.org\/resources\/us-e-cigarette-regulations-50-state-review\">\u00a0The Public Health Law Center<\/a>\u00a0has gathered together every state\u2019s regulation for e-cigarettes (as of June 15, 2016), which includes the specific state code \/ law reference. We\u2019ve also compiled each state\u2019s stance on e-cigarettes regulations with links to current information on current or forthcoming laws and potential no vaping signage templates. This state by state guide is the in the next section after these frequently asked questions.<\/p>\n<\/div><h2 class=\"bde-heading-15608-115 bde-heading\">\nDoes signage protect a property or business from the use of e-cigarettes?\n<\/h2><div class=\"bde-rich-text-15608-116 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p>Signage laws for e-cigarettes are determined at a state and\/or local level And typically fall into the same laws as smoking signs. Signage may be available at the local level; \u00a0for example, the\u00a0<a href=\"http:\/\/www.beverlyhills.org\/cbhfiles\/storage\/files\/9645534841867881185\/NoSmokingVapingPostcardFIN2logojpeg.pdf\">city of Beverly Hills provides a printable postcard<\/a>\u00a0with the city\u2019s regulations on smoking and e-cigarettes.<\/p><p><b>Is there a specific logo that I need to use for signage?<\/b><\/p><p>There\u2019s no specific e-cigarette symbol used on signage, but typically it looks like the logo below, which is similar to the no smoking symbol.<\/p><p><b>Where should signage be posted?<\/b><\/p><p>Signs should be conspicuously posted at all entrances of a property and in areas inside the building where smoking \/ vaping is prohibited.<\/p><p><b>Is e-cigarette secondhand emissions dangerous?<\/b><\/p><p>Any type of second smoke or emissions can pose a health risk. The\u00a0<a href=\"http:\/\/www.lung.org\/stop-smoking\/smoking-facts\/e-cigarettes-and-lung-health.html?referrer=https:\/\/www.google.com\/\">American Lung Association<\/a>\u00a0states that e-cigarette vapor can be potentially harmful. The state enacted laws for smoke-free university campuses beginning August 1, 2010. Vaping is not permitted on school campuses, childcare or healthcare facilities (see\u00a0<a href=\"http:\/\/law.justia.com\/codes\/arkansas\/2014\/title-6\/subtitle-2\/chapter-21\/subchapter-6\/section-6-21-609\">Arkansas Code Annotated \u00a7 6-21-609<\/a>). It is also unacceptable to use e-cigarettes near state park buildings.\u00a0<b>There are no current signage laws applicable to vaping, but we assume that you must abide by \u2018no smoking\u2019 signs posted at the mentioned locations.<\/b><\/p>\n<\/div><div class=\"bde-div-15608-148 bde-div\">\n  \n  \n\t\n\n\n\n<a class=\"bde-container-link-15608-149 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=6dea5e2d-dcc7-44a1-9af2-341a191d2485\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-15608-150 bde-image2\" src=\"https:\/\/signs-blog.signs.com\/blog\/wp-content\/uploads\/2017\/02\/no-vaping-sign-7-300x225.png\" alt=\"no vaping template 7\" loading=\"lazy\" sizes=\"(max-width: 300px) 100vw, 300px\">\n\n<\/a><a class=\"bde-container-link-15608-151 bde-container-link breakdance-link\" href=\"https:\/\/www.signs.com\/design\/?id=25ec9a40-1c5b-4856-a0a7-53311f0998a3\" target=\"_self\" data-type=\"url\">\n  \n  \n\t\n\n\n\n<img decoding=\"async\" class=\"bde-image2-15608-152 bde-image2\" src=\"https:\/\/signs-blog.signs.com\/blog\/wp-content\/uploads\/2017\/02\/no-vaping-sign-8-300x300.png\" alt=\"no vaping template 8\" loading=\"lazy\" sizes=\"(max-width: 300px) 100vw, 300px\">\n\n<\/a>\n<\/div><h2 class=\"bde-heading-15608-153 bde-heading\">\nCalifornia\n<\/h2><div class=\"bde-rich-text-15608-154 bde-rich-text decoration-none breakdance-rich-text-styles\">\n<p>California has clearly defined laws on e-cigarette use in the California Business and Professional Code. As of May 4, 2016, e-cigarettes are treated as tobacco cigarettes, meaning that vaping is banned wherever smoking is prohibited (see the\u00a0<a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201520162SB5\">Stop Tobacco Access to Kids Enforcement (STAKE) Act<\/a>). Likewise, we\u2019d assume that no vaping signage in any other city that has enacted similar legislation would have the force of law.
